5. More about Google Analytics 4

• We use IP anonymization; Google shortens your IP address before saving it.

• Data may be processed on Google LLC servers in the USA. Transfer relies on Standard Contractual Clauses plus extra safeguards (Art. 46 GDPR).

• You can also block GA4 globally by installing the “Google Analytics Opt-out” browser add-on.

6. Changes to this policy

As the site develops or laws change, we may update this document. We will announce major changes through a banner or notice at least 7 days before the new version starts.

1. General provisions

1.1  These Terms set the rules for providing, using and terminating electronic services (“Services”) by PHOTONROOF PSA, registered office: Zaczernie 190 G, 36-062 Zaczernie, Poland, KRS 0001070029, NIP 5170441473, REGON 526979867, share capital PLN 5 000 (“Service Provider”).

1.2  The Terms follow:

• Polish Act of 18 July 2002 on Electronic Services,

• the Polish Civil Code,

• Regulation (EU) 2016/679 (GDPR) and the Polish Telecommunications Act.

1.3  Every User must comply with the Terms from the moment they start using the Services.

2. Definitions

Website

the Photonroof.eu site and its sub-pages.

User

a natural person at least 16 years old or any entity that uses the Services.

Newsletter

periodic e-mails with commercial information about the PhotonRoof® product and ML System Group activities.

Services

free electronic services:

• browsing Website content,

• contact form,

• newsletter subscription (optional),

• downloading files (e.g. PDFs, BIM).

3. Type and scope of services

3.1  The Website provides information about the PhotonRoof® solar roof tile and lets Users:

• send questions via the contact form,

• subscribe to the newsletter (double opt-in),

• download PDF/BIM materials.

3.2  The contract for browsing content is concluded when the Website is displayed and ends when the User leaves the site.

3.3  The contract for the contact form or newsletter starts when the form is successfully sent or the newsletter subscription is confirmed and ends when:

• the e-mail address is removed via the “Unsubscribe” link, or

• the User effectively requests termination of the Service.

4. Technical requirements

4.1   Minimum: an internet-enabled device and an up-to-date web browser (Chrome, Firefox, Edge, Safari) with JavaScript and cookies enabled.

4.2   The Service Provider strives to keep the Website free of errors and malware but recommends current antivirus software.

5. User rights and obligations

5.1  The User must:

• provide truthful data,

• not publish illegal or third-party infringing content,

• use the Website without disrupting its operation

5.2  Supplying unlawful content is prohibited (Art. 8 sec. 3, Polish Act on Electronic Services).

6. Complaints

6.1  Complaints about Services may be sent:

• by e-mail: info@photonroof.eu,

• by post: PHOTONROOF PSA, Zaczernie 190 G, 36-062 Zaczernie, Poland, note “E-service complaint”.

6.2  Please include: name, e-mail address and a description of the problem.

6.3  The Service Provider will answer within 14 calendar days via the e-mail provided.

7. Liability

7.1  The Service Provider is not liable for:

• interruptions caused by maintenance, force majeure or failures beyond its control,

• consequences of false data supplied by the User or violation of the Terms.

7.2  To the widest extent allowed by law, the Service Provider excludes liability for lost profits.

8. Personal data and cookies

8.1   Personal data processing rules are in the Privacy Policy published on the Website.

8.2   Cookie use is described in the Cookie Policy published on the Website.

9. Intellectual property

9.1   All materials (texts, graphics, trademarks) on the Website belong to the Service Provider or its partners and are protected by copyright.

9.2   Copying, altering or distributing content without written permission is forbidden, except for permitted private use.

10. Changes to the Terms

10.1   The Service Provider may amend the Terms for legal or technical reasons and will post the new version on the Website.

10.2   Users will be informed of significant changes at least 7 days before they take effect via a notice on the site.

10.3   Continued use of the Website after the effective date means acceptance of the new Terms.

11. Final provisions

11.1   The Terms are available free of charge before the contract is made and can be downloaded, saved and printed.

11.2   Polish law applies to matters not covered by the Terms.

11.3   Disputes will be settled by the court competent for the Service Provider’s seat, unless mandatory consumer law states otherwise.
